Use of the EMTD Website
a. While EMTD endeavours to ensure accuracy of information on the WEBSITE, EMTD does not warrant the accuracy or completeness of the information and material on the WEBSITE.
b. EMTD may make changes to the information, content, material on the WEBSITE at any time without notice
c. All material on the WEBSITE is provided as is without any conditions, warranties or other terms of any kind
d. The information on the WEBSITE is designed for informational purposes only and is not intended that this information be relied upon by viewers or recipients of the information.
2. Use of WEBSITE
a. You are not permitted to transmit or post to or from this WEBSITE any material that is defamatory, offensive, racially discriminatory, inflammatory, pornographic, obscene, indecent, blasphemous, in breach of confidentiality or privacy, personally or technically harmful, insights violence or hatred, or encourages behaviour that would be considered criminal any country in the world.
3. Completion of Forms
a. Where form completion is required to access information, download content, access portals, send contact requests or demonstration requests, you agree:
i. that the information you supply is true and correct;
ii. to receive promotional material, special offers, invitations to webinars and events from EMT in regards to the services and solutions EMT offers as well as information pertinent to the Industry
iii. when completing a form for a product demonstration request, contact request about a solution or product, support request or registration to a webinar on a particular topic or product, it may be necessary for EMTD to share certain details about you with the relevant Vendor of a given product of interest to better aid you
4. Collection of your Information:
a. We may request information that personally identifies you (personal information) or allows us to contact you to provide a service or carry out a transaction that you have requested such as receiving information about products or services that EMTD offers, ordering e-mail newsletters, joining a limited-access site or service, or when purchasing, downloading and/or registering products offered by EMTD. The personal information we collect may include your name, title, company or organization name, work e-mail, work phone, work address, information about your job function, information about your company, information about circumstances related to your purchase, and payment information.
b. We may collect certain information about your visit, such as the name of the Internet service provider and the Internet Protocol (IP) address through which you access the Internet; the date and time you access the site; the pages that you access while at the Site and the Internet address of the Web site from which you linked directly to our site. This information is used to help improve the site, analyse trends and administer the site.
5. Control of your Personal Information:
a. Except as otherwise described above under “Completion of Forms” in section 3.a.iii, personal information you provide on the site will not be shared outside of EMTD and its controlled subsidiaries and affiliates without your permission.
b. EMTD may send out periodic e-mails informing you of issues related to a product or service you requested, or confirming you requested a product or service such as invoices and confirmations. In some services offered by EMTD, contact with the customer is a necessary part of the service. You will not be able to choose to unsubscribe to these mailings, as they are considered an essential part of the service(s) you have chosen.
6. Unsubscribe Information
a. Instructions to remove an email address are located on the bottom of every promotional email.

EMTD, any other party, whether or not involved in creating, producing, maintaining or delivering the WEBSITE, and any of EMTD’s Related Bodies Corporate and the officers, directors, employees, shareholders or agents of any of them, exclude all liability and responsibility for any amount or kind of loss or damage that may result to you or a third party (including without limitation, any direct, indirect, punitive or consequential loss or damages, or any loss of income, profits, goodwill, data, contracts, use of money, or loss or damages arising from or connected in any way to business interruption, and whether in tort (including without limitation negligence), contract or otherwise) in connection with the WEBSITE in any way or in connection with the use, inability to use or the results of use of the WEBSITE, any websites linked to the WEBSITE or the material on such websites, including but not limited to loss or damage due to viruses that may infect your computer equipment, software, data or other property on account of your access to, use of, or browsing the WEBSITE or your downloading of any material from the WEBSITE or any websites linked to the WEBSITE.
b. If your use of material on this Website or the Portal results in the need for servicing, repair or correction of equipment, software or data, you assume all costs thereof.
8. Governing Law and Jurisdiction
a. This notice shall be governed by and construed in accordance with the law of South Australia, Australia. Disputes arising in connection with this notice shall be subject to the exclusive jurisdiction of the South Australian courts.
